<p>As whiplash injuries are one of the most common injuries that we deal with here, people are always interested to know <strong>how much their claim could be worth</strong>.  </p>
<p>Unfortunately, we always have to advise people that, in the initial stages of your claim, we cannot actually properly value your claim &#8211; if we gave you a figure, we would be guessing.  It is not that we don’t know what we are doing – we of course do &#8211; we are <strong>expert injury lawyers with years and years of experience</strong>; but there are <strong>so many factors that need to be taken into account when valuing your claim</strong>, and we may not have all that information at this time.<br />
<span id="more-216"></span></p>
<p><strong>So &#8211; how is your whiplash injury claim valued?</strong></p>
<p>The first thing we need to consider is the severity of your whiplash injury; is it a minor, moderate, or serve whiplash injury you have?  </p>
<p>If you have only just been involved in the accident which you got your whiplash from, it will be very difficult to know how long you are going to suffer for.  Just because you are in absolute agony in the first few days does not mean your symptoms will persist for over a year; they may die down after a week and you may be fully recovered in a few weeks &#8211; in which case you would only be said to have minor whiplash in all likelihood.  </p>
<p>Ultimately, a <strong>medical expert is best placed to diagnose you and provide you with a prognosis</strong> (let you know how long they think you will suffer for), and from this we can begin to value your claim.  We can do this by using official guidelines provided by the <strong>Judicial Studies Board</strong> (JSB) which suggest the following:</p>
<ul>
<li>Minor whiplash = £875 to £5,150</li>
<li>Moderate whiplash = £5,150 and £16,400</li>
<li>Severe whiplash = well this could be anything up to £97,000!</li>

<p>In my experience I have seen many people’s whiplash claims settle for anywhere between £1,000 &amp; £4,000 and the <strong>average whiplash payout is generally around £2,500</strong>.</p>
<p><em>What I have just talked about is only the first part of properly valuing your claim though! </em> </p>
<p>The law states that you can be compensated for any losses that stem from your accident as well. For example, if you have had to take time off work, you can recover any <strong>loss of earnings</strong> your may have suffered &#8211; or if you have had to have someone in to help you do your normal chores because of the severity of your injury, you can <strong>make a claim to recover the costs of getting this care and assistance</strong>.</p>
<p>So, say you have had 2 weeks off work because of your accident, and you would have earned £500 during those 2 weeks, if you have not received any sick pay or benefits, you could make a claim to get that full £500 back. Alternatively, if you had received sick pay of £150, you can still make a claim, but only for the £350 you have lost out on. What’s more, these are not the only types of losses you can recover.  A claim can be made for any <strong>medication costs</strong> or the <strong>costs of travelling to and from your GP or hospital</strong> for medical appointments, for example.</p>
<p>As you can see, at the start of your <a href="http://www.whiplash-claims.com/">whiplash injury claim</a>, no-one can precisely value your claim because they do not know the severity of your injury, when you will fully recover, and they do not know the impact this will have on you going to work, and the amount of any other losses you may suffer as a result of suffering from whiplash.  </p>

This can cause a whole host of problems, especially for insured drivers.  At Whiplash Claims we often receive enquiries from people who have been involved in an accident with an uninsured driver and who are unsure how they can go about getting the compensation they deserve.  After all, the usual route for getting compensation is through the negligent party’s insurer.</p>
