Whiplash- this word gets banded around so much that it can sometimes be seen as a bit of a joke. However, this is far from the truth – whiplash can be extremely painful and debilitating and unfortunately often gets worse before it gets better. Whiplash is an injury that can last for a long time and can affect everyday activities such as driving. So how can you ensure that you get the maximum amount of compensation?

Unfortunately, as this injury is very common, there are a lot of traps set to try and get these types of claims rushed through as quickly as possible- mainly to avoid them being on insurance companies books.

There are two main traps: Legal Expenses Insurance (referral fees) and Third Party Capture. Average Whiplash Claim Payout

We are often asked “how much is my claim worth?” Or “how much compensation am I likely to receive?” The first point to note is that no solicitor can say with any certainty how much you are likely to receive at the start because, at the outset, you do not have medical evidence.

Medical evidence will give a Solicitor an insight into your injuries and the effect of those injuries on your life. A medical report should also give a prognosis such as that you have sustained “a 12 month whiplash type injury to your neck and back.”

The medical report may note that you also sustained moderate psychological effects of travel anxiety as a driver and as a passenger. With more complex injuries or symptoms, more than one medical report may be necessary; for example you may need to be examined by a General Practitioner (GP) Expert and a Psychologist.

Whiplash Claims – How Much do you Get?

One of the most common questions asked by a client claiming for a whiplash injury after an accident is “How much am I likely to receive?” This can sometimes be quite easy to estimate, especially if the whiplash injury has recovered and we have knowledge of how long you have been suffering for.

However, more often than not, when a client approaches us here at Whiplash Claims, the injury is very recent and symptoms can still be quite severe. This is where it is difficult to estimate to a client how much they are likely to receive if their claim is successful.

Whiplash Claims Valuations

With this knowledge you are also likely to be curious as to how much your claim is worth – what sort of money will you get at the end of process? We know that the vast majority of people who have suffered a whiplash injury resulted from some sort of road traffic accident. As I have said, many whiplash injuries often stem from road traffic accidents – for instance, where a negligent third party driver collides with the rear of a stationary vehicle. That said, whiplash can also be sustained from playing sports or from slipping or falling, but it is fair to say that most of the whiplash injuries do stem from road traffic accidents.
